SC comes to the rescue of 3 booked in Tripura under UAPA

NEW DELHI: The Supreme Court today directed the Tripura police not to take any coercive action against two human rights activists and a journalist Shyam Meera Singh, in connection with a first information reports (FIR) lodged under the stringent Unlawful Activities (Prevention) Act (UAPA) provisions.

A bench headed by Chief Justice of India NV Ramana and comprising Justice DY Chandrachud and Justice Surya Kant also issued notice to Agartala police on the plea filed by advocates, Mukesh and Ansarul Haq, and journalist Shyam Meera Singh against the lodging of the FIR and also challenging the vires of Section 2(1)(o) of UAPA which defines ‘unlawful activity.'

The Tripura Police had booked the petitioners including human rights activists, Mukesh and Ansar Indori, Singh and other activists and lawyers for offences punishable under the UAPA allegedly for posting facts through social media posts about "targeted violence" against the minority community in the state in the last month. 

Tripura has been at the centre of a controversy following reports of an alleged slew of attacks on mosques across the state. According to these reports, mosques and Muslim-owned shops had been vandalised in the week between 19 October and 26 October.

The Union Home Ministry has however said there had been no reported case of damage to the structure of any mosque in Tripura in the recent past.

According to petitioner Singh, the BJP-led Tripura Government had slapped UAPA charges against him for his tweet which said, "Tripura is burning."

Last week two young lady journalists, Samriddhi Sakunia and Swarna Jha, had been detained by the Tripura Police for their reports on the communal violence in the State, however, they were granted bail by the Chief Judicial Magistrate court in Gomati district.
